(3) The production, productive capacity, and classified lists of establishments forming data for an estimate of the productive capacity, of important materials for military use other than arms by factories and workshops producing, or capable of being converted to the production of, the same, the total number of employees belonging to such establishments, or classified lists thereof, and the production plans of the Government and books, &c., indicating the same. (4) The stocks of important materials for military use stored in the country as a whole or in a section thereof, the capacity of storage establishments, the stocks of such materials in, and the storage capacity of, important storage establishments forming data for an estimate thereof, Government plans for the storage of such articles, and books, &c., indicating the same.
(5) The stocks of important materials for military use which the Govern- ment causes to be stored, the storage capacity of establishments where the Government has caused such materials to be stored, the Government's plans in regard to orders for the storage of such materials, and books, &c., indicating the same.
(6) The imports of important materials for military use imported in the country as a whole, in a section thereof, or in any important port or ports, the Government's import plans, and books, &c., indicating the same.
(7) The total number of persons specially trained for military employment in the country as a whole or in a section thereof, or of other important personnel, or classified lists thereof, and books, &c., indicating the same.
(8) The total number of aeroplanes, motor cars, or horses, for military use in the country as a whole or in a section thereof, classified lists thereof, and books, &c., indicating the same.
(9) The transportation capacity of important military railways, transporta- tion statistics forming data for an estimate thereof, books, &c., indicating the same, and important records and diagrams, and the contents thereof, relating to the equipment of important military railways and their rolling-stock.
(10) Important records and diagrams, and the contents thereof, relating to important military aerodromes or their equipment.
(11) Important records and diagrams, and the contents thereof, relating to special equipment in vessels for military use.
(12) Important systems of communication for military use and the capacity thereof, books, &c., indicating the same, and important records and diagrams, or the contents thereof, relating to important communication equipment for military use or the capacity thereof or connecting systems.
(13) Particulars or books, &c., relating to important experiments and researches made under orders from, or at the request of, the Minister of War or the Minister of Marine, or inventions and contrivances which require to be kept secret for military reasons.
(14) Important particulars or books, &c., relating to weather conditions, which require to be kept secret for military reasons.
(15) Establishments coming under sub-headings (2) to (5) and (9) to (12), inclusive, which require special measures of secrecy, establishments relating to the experiments and researches mentioned in sub-heading (13), their structure and functions, and books, &c., indicating the same.
Art. 3. (Provides for cancellation of "designation" in the case of matters which no longer require to be kept secret.)
Art. 4. (Provides that the Ministers of War or Marine may, in accordance with the terms of an Imperial Ordinance, cause books, &c., dealing with secrets relating to military resources to be specially marked.)
Art. 5. (Provides that the Ministers of War or Marine may order those responsible for establishments under sub-heading (15) of article 2 to conceal the same or to take other measures necessary to ensure secrecy.)
Art. 6. (Provides that the competent Minister of State may prohibit or restrict entry into establishments coming under sub-heading (15) of article 2, or surveying, photographing, copying, &c., therein)
Art. 7. (Provides that, when specially necessary for the purpose of preserving secrets relating to military resources, the Government, in accordance with the terms of Imperial Ordinance, may restrict the inspection of, or the issue of copies of, or extracts from, register books in which such secrets are recorded.)

Art. 8. (Provides that, when specially necessary for the purpose of breserving secrets relating to military resources under sub-headings (2) or (15) of article 2, the Government, in accordance with the terms of an Imperial Ordinance, may prohibit or restrict the disclosure, &c., of secrets regarding such resources in the case of applications, petitions or reports, made in accordance with law, or in cases where entrance or inspection is requested, or enquiries are made.)
Art. 9. (Provides that the Ministers of War or Marine may require reports from persons to whom orders have been issued under article 5, or may send officials to enter and inspect establishments or may question those in charge.)
Art. 10. (Provides for the payment by the Government, in accordance with the terms of an Imperial Ordinance, of indemnities in respect of losses due to orders under article 5. An appeal against the amount of indemnity fixed can be made.)
Arts. 11-22 (Penal clauses). The penalties prescribed are:--- (a) Penal servitude for not more than ten years in the case of persons— (1) Who enquire into, or collect, secrets under the law with the object of revealing them to foreign countries, or to persons acting on behalf of a foreign country, or of making them public (article 11); or (2) Who, otherwise than in the course of their business, learn or obtain possession of such secrets and reveal them to foreign countries, or to persons acting on behalf of a foreign country, or make them public (article 12).
(b) Penal servitude for not less than one year in the case of persons who in the course of their business learn or obtain possession of secrets under the law and reveal them to foreign countries, or to persons acting on behalf of a foreign country, or make such secrets public; or persons who have enquired into or collected secrets with the object of making them public or of revealing them to foreign countries, or to persons acting on behalf of a foreign country, and make such secrets public or reveal them as above (article 12).
(c) Penal servitude for not more than five years in the case of persons who have formed an organisation for the purpose of enquiring into, collecting and revealing secrets with the object of disclosing them to foreign countries or to persons acting on behalf of a foreign country, or persons who have taken a leading part in such organisations (article 15).
(d) Penal servitude for not more than two years in the case of persons who have joined organisations under (b) knowing the circumstances (article 15).
(e) Penal servitude for not more than two years, or a fine of not more than 2,000 yen, in the case of persons who, in the course of their business, learn or obtain possession of secrets and reveal them to foreigners (article 13).
(f) Penal servitude for not more than one year, or a fine of 1,000 yen, in the case of persons who, otherwise than in the course of their business, learn or obtain possession of secrets and reveal them to foreigners (article 13).
(g) Penal servitude for not more than six months, or a fine of not more than 500 yen, in the case of persons-
(1) Who have learned, or are in possession of, secrets under sub-headings (2)
or (15) of article 2 and reveal them to others (article 14); or
(2) Who have acted contrary to a prohibition or restriction issued under
article 6 (article 16).
(h) A fine of not more than 3,000 yen in the case of persons who have acted contrary to an order issued under article 5 (article 17).
(2) A fine of not more than 500 yen in the case of persons who have acted contrary to a restriction order issued under article 7, or have evaded orders issued under article 9 or make a false report, &c. (article 18).
(1) Attempts to commit offences under articles 11 and 12 are also punishable (article 19).
Art. 23. (Provides that the penal regulations are applicable to any person who has committed an offence under the law outside the areas in which the law is enforced.)
Art. 24. (Provides that secrets regarding military resources may be revealed to others provided permission is obtained in accordance with the terms of an Imperial Ordinance.)
